Adoption was unknown at common law; it exists solely by statute. Adoption is governed specifically by Chapter 162 of the Texas Family Code. C. Other statutory law, both state and federal, must also be consulted concerning adoptions. The Texas Penal Code provides that the sale or purchase of a child is a criminal offense. The Human Resources Code governs facilities and agencies that care for children who are being placed for adoption. When an adoption involves a child brought to Texas from a sister state, the Interstate Compact on the Placement of Children and the Interstate Compact on Adoption and medical assistance should be reviewed. Finally, when the child to be adopted is a member of, or is eligible to be a member of, an American Indian tribal organization, the Indian Child Welfare Act of 1978 comes into play.
